Ratio Decidendi

The court found that the respondent failed to establish a valid reason for the claimant's termination, as there was no evidence linking the claimant to the disappearance of the oncology drugs. The disciplinary process did not substantiate the allegations made in the interdiction and show-cause letter. Consequently, the termination was declared unfair under section 43(1) of the Employment Act, 2007. The court declined to order reinstatement due to the claimant's abandonment of that prayer, but awarded the claimant withheld half salary for the interdiction period and 12 months’ gross salary as compensation for unfair termination, as well as costs of the suit.
