The appellant failed to demonstrate that the award of Kshs. 50,000/- was so inordinately low as to constitute an erroneous estimate of damages. Therefore, there was no justification for the appellate court to interfere with the trial court's discretion in the assessment of damages. The appeal was dismissed for lack of merit.
