The Respondent did not respond to the Claimant's queries or participate in the proceedings, and the Claimant's evidence was uncontroverted. The Tribunal held that the deductions were unprocedural and unlawful, and that the Claimant was entitled to a refund of all monies deducted under the purported 10% top up fee, as well as an injunction restraining the Respondent from making further such deductions. The Tribunal also awarded interest and costs to the Claimant.
