His subsequent failure to report to work constituted desertion. However, the respondent failed to follow due process as required by section 41(2) of the Employment Act by not making reasonable efforts to trace the claimant or subject him to disciplinary proceedings. This rendered the closure of the contract irregular and unlawful. The respondent cannot be held liable for claims relating to ENA Investment Ltd and Classic Parcel Handlers Ltd, as they are separate legal entities and there was no evidence of an agency relationship.
