The Tribunal found that there was a misunderstanding between the parties regarding the period for which ETR receipts were to be issued at the time of recording the consent order. Since the Landlord had not provided ETR receipts for the period 2021-2023 and for certain months in 2024, and the Tenant had already deposited the undisputed rent arrears in escrow, the consent order was set aside. The Tribunal held that it would be unfair to allow the Landlord to levy distress for rent while the Tenant had complied with the escrow arrangement and the Landlord had not fully complied with the consent order.
