Ratio Decidendi

The High Court found that the Small Claims Court lacked jurisdiction to entertain a declaratory suit, as such suits do not fall within the categories of claims set out in Section 12 of the Small Claims Court Act. The purpose of a declaratory suit is to compel an insurer to settle a decree passed against its insured, which is not among the matters the Small Claims Court is empowered to determine. The trial court therefore erred in law by hearing and determining the suit. As a result, the High Court set aside the judgment of the Small Claims Court without delving into the merits of the evidence or the substantive issues raised in the appeal, as the lack of jurisdiction was dispositive.
