The High Court held that the lower court lacked jurisdiction to grant leave to file the declaratory suit out of time, as Section 27 of the Limitation of Actions Act does not apply to the enforcement of judgments or decrees. The suit was brought more than 12 years after the judgment in the primary suit, making it statute-barred under Section 4(4) of the Limitation of Actions Act. The court found that the alleged acknowledgment letters relied upon by the Respondent did not relate to the present claim and thus could not revive the limitation period under Section 23(3). Consequently, the trial court erred in dismissing the preliminary objection and in entertaining a suit that was incompetent...
