Procedural Posture

Miscellaneous Application / Ruling on Application for Denial of Audience and Payment of Taxed Costs

  1. 1 Whether failure to pay taxed costs constitutes contempt of court or abuse of process justifying denial of audience to the respondents.
  2. 2 Whether the respondents should be denied audience until payment of Kshs.5,266,359 as certified costs.
  3. 3 Whether the application to deny audience is made in bad faith.

Ratio Decidendi

The court found that the applicants failed to demonstrate that the respondents were in contempt of any court order or that their conduct amounted to abuse of court process. The mere failure to pay taxed costs does not amount to contempt or justify denial of audience. The application was deemed to be an attempt to block the respondents' application from being heard and was made in bad faith. The court emphasized that the right to be heard is fundamental and cannot be denied on the basis of non-payment of costs. The proper procedure for enforcement of costs is through execution, not by seeking to deny a party audience. Accordingly, the application was dismissed with costs.
