Procedural Posture

Criminal Appeal / Second Appeal From High Court Judgment Affirming Conviction and Sentence

  1. 1 Whether the first appellate court properly re-evaluated and re-analysed the evidence as required by law.
  2. 2 Whether the identification of the appellant was safe and reliable.
  3. 3 Whether the prosecution proved the charge of defilement beyond reasonable doubt.

Ratio Decidendi

The Court of Appeal held that the first appellate court properly discharged its duty by re-evaluating the evidence and addressing all material issues, including identification, the alleged grudge, and the alibi defence. The evidence, including eyewitness testimony and medical findings, established the offence of defilement beyond reasonable doubt. The mandatory life sentence imposed was lawful under section 8(2) of the Sexual Offences Act, and the constitutionality of the indeterminate sentence could not be considered as it was not raised in the High Court. The severity of sentence is not a point of law for the Court of Appeal to interfere with on second appeal unless illegality is shown....

Court Disposition

Appeal dismissed; conviction and sentence upheld.

Orders

  • The appeal against conviction and sentence is dismissed in its entirety.
  • The conviction and sentence of life imprisonment are affirmed.
