Criminal Miscellaneous Application / Ruling on Application for Review of Sentence

  1. 1 Whether the High Court has jurisdiction to review the applicant's sentence after a previous application for review was dismissed.
  2. 2 Whether the applicant has demonstrated circumstances warranting review of the sentence.

Ratio Decidendi

The High Court declined to review the applicant's sentence because it had already determined a similar application for review in Miscellaneous Criminal Revision No. E009 of 2023, which was dismissed. The applicant failed to demonstrate any new or exceptional circumstances as required by law and as outlined by the Supreme Court in Fredrick Otieno Outa v Jared Odoyo Okello & 3 others [2017] eKLR. The court held that it lacked jurisdiction to entertain a repeat application for review on the same grounds and directed the applicant to seek redress either by appealing to the Court of Appeal or by seeking review of the previous orders through the appropriate forum.
