The applicant was dismissed on 15th September 2008, and his cause of action expired in September 2011. The court found that the existence of a pending criminal trial did not prevent the applicant from filing his civil claim within the prescribed period. There is no statutory provision allowing the court to extend time beyond the three-year limitation. Consequently, the court lacked jurisdiction to entertain the application for extension of time, and the suit was time-barred.
