The absence of evidence that the applicant was served with the notice justified the grant of leave to appeal out of time. The court further held that no prejudice would be suffered by the respondent if the application was allowed, as he would have the opportunity to challenge the appeal. The application was therefore allowed, and the applicant was granted 14 days to file and serve the appeal.
