The appellate court found that the trial magistrate failed to indicate which statutory factors were considered in declining to award compensation for unfair termination, despite a clear finding that the dismissal was unlawful. The court held that such discretion must be exercised judiciously and in accordance with the principles set out in section 49(4) of the Employment Act. Given the appellant’s eight years of service, the breakdown of her marital relationship with a director of the respondent, and the lack of any indication that relevant factors were considered, the appellate court concluded that the lower court’s exercise of discretion was injudicious.
