Procedural Posture

Environment and Land Case / Judgment

  1. 1 Whether the registration of land parcel NO BUNYALA/MUDEMBI/2672 in the names of Pascal and John was fraudulent and excluded the plaintiff and her children.
  2. 2 Whether the plaintiff is entitled to a share of the suit land as the widow of Neri Ngoye.
  3. 3 Whether the first registration of land can be challenged on grounds of fraud under the Land Registration Act.

Ratio Decidendi

The court found that the plaintiff, as the widow of Neri Ngoye, had lived on the disputed land since her marriage in 1968 and was entitled to a share of the land. The registration of the land in the names of Pascal and John, to the exclusion of the plaintiff and her children, was fraudulent and inequitable. The court held that first registration does not bar a challenge on grounds of fraud, especially where the land was ancestral and meant for the benefit of the entire family. The court determined that the plaintiff had established her case and was entitled to 1½ acres of the land to hold in trust for her children, with the remainder to be held by the defendants in trust for the children...

Court Disposition

Judgment for the plaintiff against the defendants jointly and severally.
