Evidence showed contributory negligence on the part of the deceased, who was in the middle of the road despite the presence of a flyover. The Appellants, however, failed to call any witnesses to rebut the Respondent's evidence. The court apportioned liability at 70% for the Appellants and 30% for the Respondent. The awards for pain and suffering (Kshs 50,000), loss of expectation of life (Kshs 150,000), loss of dependency (Kshs 1,615,800), and special damages (Kshs 1,075) were found reasonable and not excessive.
