The court found that while the Appellant's conduct—being absent from work and reporting while intoxicated—constituted valid grounds for termination under section 44 of the Employment Act, the Respondent failed to accord the Appellant a fair hearing as required by section 41. This procedural lapse rendered the dismissal unfair. The trial Magistrate erred only in failing to recognize the lack of a disciplinary hearing. The Appellant was entitled to compensation for unfair dismissal, but only to the extent of one month's salary, given his contributory conduct.
