Ratio Decidendi

The law requires that special damages be strictly proven, and in the absence of evidence of actual expenditure, the award of Kshs. 496,000/= as special damages was erroneous. The appeal was therefore allowed, the judgment of the subordinate court set aside, and the respondent's suit dismissed with costs to the appellant.
