The majority of the Court of Appeal held that the respondent's suit to enforce the advocate's professional undertaking was premature because, at the time of filing, the sale transaction had not been completed as the full purchase price had not been paid. The professional undertaking was expressly conditional upon completion, which, under the sale agreement and the incorporated Law Society Conditions of Sale, meant payment of the entire purchase price.
