Ratio Decidendi

The court found that the claimant's suit was statute-barred because he failed to pursue the mandatory conciliation process through the Minister for Labour as required under the Trade Disputes Act (Cap 234) in force at the time of dismissal. Additionally, the claimant delayed for seven years before filing suit without leave of court. The Employment Act 2007 did not apply retrospectively to the claimant's cause of action. As a result, the court declined to take cognizance of the dispute or deal with it, dismissing the claim on the basis of limitation without addressing the merits of the dismissal itself.
