Procedural Posture

Civil Case / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the court should grant a stay of execution of its ruling dated 22nd January 2018 pending appeal.
  2. 2 Whether the order sought is positive or negative in nature and if a stay can be granted against such an order.

Ratio Decidendi

The court found that the order of 22nd January 2018, which required the 1st defendant to deposit a sum of money as a condition for setting aside an interlocutory judgment, was in substance a negative order. Granting a stay would serve no purpose because it would merely restore the interlocutory judgment against the 1st defendant, which is not the relief sought. The jurisprudence is clear that stays are not granted against negative orders, and the application for stay was therefore without merit.
