The court also held that the applicant would suffer irreparable harm if compelled to pay the decretal sum from donated funds, and that the respondent had not provided sufficient evidence of her ability to refund the sum if the appeal succeeded. Consequently, both limbs for the grant of stay of execution under rule 5(2)(b) were satisfied, warranting the grant of stay pending the determination of the intended appeal.
