The High Court held that while the Appellant initially submitted to the jurisdiction of the Kadhi’s Court by filing pleadings and participating in the proceedings, she subsequently exercised her constitutional right to withdraw that submission by expressly stating her intention not to be bound by the Kadhi’s Court. The Court found that submission to the Kadhi’s Court must be voluntary and can be withdrawn at any stage, as supported by Article 170(5) of the Constitution and relevant case law. Since the Appellant provided clear evidence of her withdrawal, the Kadhi’s Court no longer had jurisdiction to hear the matter.
