Procedural Posture

Notice of Motion Application / Ruling on Interlocutory Injunction

  1. 1 Whether the plaintiffs have established a prima facie case for grant of an interlocutory injunction against the defendant.
  2. 2 Whether the plaintiffs have demonstrated irreparable injury if the injunction is not granted.
  3. 3 Whether the balance of convenience lies in favour of granting the injunction to the plaintiffs.

Ratio Decidendi

The court found that the plaintiffs failed to establish a prima facie case for an injunction. The evidence showed that the land in question was originally Wakf land belonging to the Mazrui family, and the allocation to the plaintiffs' predecessor was nullified following the High Court's declaration that the repeal of the Mazrui Lands Trust Act was unconstitutional. The Takaungu Adjudication Section and its allocations were thus invalidated, reverting ownership to the Mazrui family. The defendant demonstrated it had leased the land from the rightful owners. The plaintiffs did not contest the effect of the High Court decision or the land's status under the Mazrui Lands Trust Act....
