The court held that the preliminary objection on jurisdiction was a proper point of law, but upon examining the plaint, the dispute concerned funds held in a bank account and not the use, occupation, or title to land. Applying the dominant issue test, the court found the matter fell outside the jurisdiction of the Environment and Land Court and within the jurisdiction of the High Court. The objection on res judicata was dismissed as it required reference to evidence not permissible in a preliminary objection. Consequently, the preliminary objection was found to lack merit and was dismissed with costs.
