Ratio Decidendi

The court found that the plaintiffs were not parties to the previous proceedings whose pleadings and witness statements they sought to rely on. Furthermore, the defendants had not had the opportunity to cross-examine the witnesses in those cases, and the requirements of Section 34(1)(b) and (c) of the Evidence Act had not been satisfied. As such, the plaintiffs could not rely on those documents in the present suit. The objection by the defendants was therefore sustained, and the plaintiffs' bundle of documents filed on 3rd July, 2018 was struck out. The court directed the parties to fix a hearing date for the main suit on a priority basis.
