The defendant's claim to plot UNSW – 30 was unsupported by any valid sale agreement, lease, or allotment letter, and all documentary evidence of rates and demand notes were in the name of a third party, John Ngome, who had no title to transfer. The court determined that plot UNSW – 30 is in fact the same land as the plaintiffs' registered property.
