The court found that the interested party, Sanjeev Agarwal, was neither a party before the Political Parties Disputes Tribunal (PPDT) nor in the appeal before the High Court. Section 41(2) of the Political Parties Act only allows appeals to the High Court from decisions of the PPDT, and since the applicant had not filed a claim at the PPDT, he had no right of appeal.
