The court found that although the Plaintiff failed to comply with the time limit for amending the plaint, this failure did not occasion any prejudice to the 2nd Defendant, who had entered appearance and filed a Defence. The court exercised its discretion under Order VIA Rule 8 to grant an extension of time for the amendment of the Plaint, deeming the Amended Plaint as properly filed within time. The application to strike out the Amended Plaint was therefore dismissed, but the Plaintiff was ordered to pay the costs of the application to the 2nd Defendant.
