Ratio Decidendi

The Tribunal found that the Appellant failed to provide or place on record the appealable decision as required by Section 13(2)(c) of the Tax Appeals Tribunal Act. This omission is fatal to the appeal, as the provision is mandatory and jurisdictional. Without the appealable decision, the Tribunal has no basis to entertain or determine the appeal. Consequently, the appeal was found to be improperly before the Tribunal and was struck out without consideration of the substantive tax issues raised by the Appellant. Each party was ordered to bear its own costs.
