The court held that the applicants had met the criteria for the grant of leave to file an appeal out of time, as set out in Salat v IEBC & 7 others, and that the respondent had not demonstrated any prejudice that would result from the extension. The court emphasized that the mistake of counsel should not be visited upon an innocent litigant and exercised its discretion to allow the application.
