The court held that the validity of preservation orders under the Proceeds of Crime and Anti-Money Laundering Act is not dependent on the outcome of criminal proceedings, as civil forfeiture proceedings are independent and can proceed regardless of acquittal or conviction in criminal court. Section 92(4) of POCAMLA expressly provides that the outcome of criminal proceedings does not affect the validity of forfeiture or preservation orders. The court found that the application to rescind the preservation orders was premature because the forfeiture proceedings were still pending and had not been concluded.
