Procedural Posture
Civil Application / Ruling on Oral Application for Stay of Execution
Legal Issues
- 1 Whether the applicant is entitled to a stay of execution of the judgment pending appeal.
- 2 Whether the court has discretion to grant a stay of execution upon oral application.
Ratio Decidendi
The court held that although the applicant's case had been dismissed, it retains a right of appeal and, consequently, a right to seek a stay of execution to preserve the subject matter pending appeal. The court recognized that the power to grant a stay is discretionary and must be exercised judiciously. In this instance, the court found it appropriate to grant a temporary stay of execution for thirty days to allow the applicant time to consider its options and, if necessary, file a formal application for stay or an appeal. The court emphasized that the stay was granted on an oral application and is limited in duration, after which a formal application may be made if the applicant so desires.
Court Disposition
Stay of execution granted for thirty days on oral application; certified copy of judgment to issue.
Orders
- A stay of execution of the judgment is granted for thirty days from the date hereof.
- The aggrieved party may make a formal application for stay within the thirty days if so advised.

Ruling
1. With due respect, even though the court has dismissed the Applicant’s case it has a right of appeal and hence a right to have the court determine whether the judgment ought to be stayed so that it can decide whether to appeal or not bearing in mind that whether or not to grant a stay is in the discretion of the court.
4. An oral application for stay is however granted for 30 days after which the aggrieved party may make a formal application. In the premises the Applicant is granted a stay of execution for thirty days.
3. A certified copy of the judgment to issue.
