Ratio Decidendi

The Tribunal found that after the expiry of the written lease, the applicant continued to occupy the premises and pay rent, with the landlord accepting such payments, thereby creating a controlled tenancy under Cap 301. The notice of termination issued by the landlord was found invalid as it was not in the prescribed form and did not provide the statutory two months' notice. On the issue of rent arrears, the Tribunal determined that the applicant failed to prove payment of arrears accrued during the lease and that no evidence was provided of an agreement to reduce rent. The Tribunal accepted the landlord's statement of accounts and found the applicant in arrears of KShs. 4,313,170.00....
