Although the applicant attributed the delay to bereavement and illness, no documentary evidence was provided to substantiate these claims. Furthermore, the applicant did not produce a certificate of delay, which is necessary to benefit from the exclusion of time under the proviso to Rule 82 of the Court of Appeal Rules. As a result, the delay was deemed inordinate, and the court declined to exercise its discretion in favour of the applicant. The application for extension of time was therefore dismissed with costs to the respondent.
