In the circumstances, the court considered it appropriate to grant a conditional stay of execution pending determination of the remaining prayers in the application, on the condition that the balance of the decretal amount (Kshs. 433,242) be deposited in court within 30 days. Failure to comply would entitle the respondent to proceed with execution.
