The Tribunal found that the Appellant filed its appeal prematurely, as it was lodged before the statutory period for the Commissioner to issue a review decision had expired. Section 229(4) of the EACCMA provides the Commissioner with up to thirty days to communicate a decision on an application for review. The Appellant filed the appeal only nine days after seeking review, and thus, no review decision had been made nor had the statutory period lapsed. Consequently, the Tribunal held that the appeal was not properly before it and was incompetent.
