The court found that although the relocation of the polling station from Nidhamia Hall to Malindi High School was made without prior notice and was not ideal, all aspirants, including the appellant, were made aware of the change and participated in the nomination process. The votes cast at Malindi High School were comparable to those at other stations, and excluding them would disenfranchise 245 voters and distort the electoral process. The court held that the irregularities did not materially affect the outcome, as the 1st Respondent still garnered the highest number of votes. Therefore, the nomination certificate was validly issued to the 1st Respondent, and the appeal lacked merit.
