The court exercised its discretion in favour of the applicant, noting that the previous appeal was struck out due to failure to serve one of the respondents, and that the interests of justice required allowing the applicant to proceed with the appeal. The application for extension of time was therefore granted, subject to the applicant filing the notice of appeal within 7 days and the record of appeal within 14 days thereafter.
