Ratio Decidendi

The High Court held that, by operation of Section 38 of the Small Claims Court Act, appeals from the Small Claims Court to the High Court are strictly limited to matters of law. The appellant's grounds, save for the one on costs, improperly sought to challenge factual findings, which is not permissible. The only valid ground was the challenge to the award of costs. The court found that the trial magistrate exercised discretion properly in awarding costs to the successful party, as provided by law, and there were no extenuating circumstances to justify a departure from the general rule. Consequently, the appeal was dismissed in its entirety, with costs to the respondent.
