The High Court declined to entertain the application for revision because the applicant had a right of appeal against the sentence but did not exercise it. Section 364(5) of the Criminal Procedure Code expressly prohibits revision at the insistence of a party who could have appealed, unless the sentence is illegal, which was not established in this case.
