The court found that the plaintiffs were the original and rightful owners of the suit land, having purchased it from Mumwe Investments Limited in 1996 and holding the original certificate of lease. There was no evidence of a valid transfer from the plaintiffs to Stanley Kimani Irungu, and the Land Registry could not account for the alteration of records that led to his registration as owner. The fraudulent acts were attributed to officers at the Land Registry (1st defendant), who failed to require surrender of the original title before registering the transfer to Stanley Kimani Irungu. The 2nd defendant, although a bona fide purchaser for value, could not acquire a better title than that...
