In such circumstances, the suit in the subordinate court is a nullity in law. Established legal authority dictates that a nullity cannot be transferred, as there is nothing legally cognizable to transfer. The absence of pleadings from the subordinate court further prevented the High Court from independently verifying the nature of the dispute, but the applicant's categorical statements sufficed. The application to transfer the suit was therefore dismissed, as the High Court cannot transfer a nullity.
