The Court of Appeal found that there was a bona fide arguable issue as to whether the High Court's orders declaring the Kenya Government Delivery Portal unlawful and issuing a permanent injunction were limited to the election period or extended beyond it. The ambiguity in the High Court's decree regarding its temporal scope justified the grant of a stay of execution to prevent the intended appeal from being rendered nugatory.
