The Court of Appeal found that the applicant had demonstrated arguable grounds for appeal, including whether the respondents' dismissals were lawful and whether the compensation awarded was excessive. The court held that the applicant had also shown that the appeal would be rendered nugatory if stay was not granted, as public funds would be used to pay the decretal sum and there was no evidence that the respondents could refund the amounts if the appeal succeeded. The respondents failed to discharge the burden of proving their ability to refund the decretal sum. Accordingly, the court allowed the application for stay of execution pending the hearing and determination of the appeal.
