Legal Issues
- 1 Whether the applicant's sentence should be revised to allow for a community service order instead of continued imprisonment.
- 2 Whether the applicant qualifies for a community service order under the relevant legal framework.
Ratio Decidendi
The court found that the applicant, having been convicted of dealing with alcoholic drinks without a licence and sentenced to a fine or imprisonment, was eligible for a community service order based on the probation officer's report. The court exercised its discretion to revise the sentence, substituting the remaining period of imprisonment with a community service order at Riakimai Primary School, as this would serve the interests of justice and rehabilitation.
Court Disposition
Sentence revised; remaining imprisonment period to be served under community service order.
Orders
- The applicant shall serve the remaining period until 21/9/2022 under community service order at Riakimai Primary School as recommended by the probation officer.
