Ratio Decidendi

The High Court held that it lacked jurisdiction to entertain the applicant's Chamber Summons for release of property used as exhibits in a criminal case tried and concluded in the subordinate court. Section 177 of the Criminal Procedure Code vests the power to order restitution of property in the trial court. The applicant, having already applied unsuccessfully before the magistrate, could only appeal that decision and not initiate a fresh application in the High Court. The application was therefore misconceived and without merit, leading to its dismissal.
