The court held that while there may be a right to some relief against Nairobi City Council, the plaintiff does not wish to sue the council, and the defendant has not counterclaimed or sought indemnity against it. The only claim in the suit is that of the plaintiff against the defendant. The court found that it is possible to pass an effective decree in the absence of the City Council as a defendant, and that the presence of the council as a witness would suffice for the purposes of adjudication. Forcing the plaintiff to amend the plaint to sue a party he does not wish to sue would not be just. Therefore, the application to join Nairobi City Council as a 2nd defendant was dismissed.
