Procedural Posture

Employment Cause / Application for Reinstatement After Dismissal for Non Attendance

  1. 1 Whether the claimant has provided sufficient cause to set aside the dismissal order for non-attendance.
  2. 2 Whether technical hitches experienced by counsel constitute a valid reason for non-attendance in virtual proceedings.
  3. 3 Whether the respondent is entitled to costs if the suit is reinstated.

Ratio Decidendi

The court held that while dismissal for non-attendance is a serious and final order, justice requires that matters be heard on their merits where possible. The claimant's explanation of technical hitches was not fully satisfactory, as alternative means of contacting the court were available and not utilized. However, given the age of the matter and in the interest of justice, the court found it just to reinstate the suit on the condition that the claimant pays the respondent's costs assessed at Ksh.20,000 before being allocated a hearing date. The reinstatement is further conditioned on prompt action by the claimant, with the suit to stand dismissed if there is inaction for 30 days.

Court Disposition

Application allowed with conditions.
