Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the High Court has jurisdiction to hear an appeal filed out of time without leave.
  2. 2 Whether a composite appeal against two decisions is permissible under the law.
  3. 3 Whether the appellant obtained leave to file the appeal out of time.

Ratio Decidendi

The High Court lacks jurisdiction to entertain an appeal filed out of time without leave of court. The appellant filed a composite appeal against two decisions, both out of time, and failed to obtain or demonstrate leave to appeal out of time as required by section 79(G) of the Civil Procedure Act. The law requires each decision to be appealed separately and within the prescribed timelines. The absence of a properly filed appeal deprives the court of jurisdiction to question the decisions of the lower court. As a result, the appeal is incompetent and must be struck out.
