Ratio Decidendi

The court found that the trial court erred in applying the multiplier approach to assess damages for loss of dependency in the absence of any proof of the deceased's income or gainful employment. The only evidence was the widow's testimony, which did not establish the deceased's earnings or whether farming was a commercial venture. No documentary evidence was produced. In such circumstances, the global approach is the appropriate method for assessing damages. The court therefore set aside the award of Ksh.2,714,400 for loss of dependency and substituted it with a global award of Ksh.800,000. The rest of the trial court's awards were affirmed.
